Article 1. Terms and Definitions. General Provisions.

1. The terms and definitions contained in the Public Offer are used in the following meanings:
Seller – Public Organization "HALOM", identification code 40032305, located at: 03150, Kyiv, Kazymyra Malevycha St., 86 O, email address: [email protected], phone numbers: +380 99 544 89 36, +380 68 941 88 05.

Website – the Seller's website, located on the Internet at: https://halom.org/, including all its web pages; the owner and administrator of the Website is the Seller.

Services – services for organizing recreation, entertainment, and cultural leisure activities offered for sale by the Seller, the description of which is posted on the Website.

Public Offer – a public proposal addressed to an unspecified number of individuals by the Seller to enter into an electronic contract for the sale of Services under the terms specified by the Seller.

Acceptance – the action taken by the Buyer aimed at accepting the terms of this Public Offer.

Buyer – any legally capable individual according to the current legislation of Ukraine, who intends to purchase Services for personal use not related to entrepreneurial activities, who has accepted the terms of the Public Offer and purchased a Ticket through the Website's information system.

Registration – the process by which the Buyer fills out the appropriate form on the Website, providing the necessary information. To register on the Website, the Buyer must provide their last name, first name, patronymic, address, phone number, and email address.

Ticket – a document issued by the Seller confirming the Buyer's right to receive the Services specified therein. The Ticket is not a payment instrument or payment document.

2. The Public Offer is a proposal made by the Seller to an unspecified number of individuals and contains all the essential terms for entering into an electronic contract for the sale of Services under the conditions specified below.

3. By accepting the Public Offer, the Buyer confirms their full and unconditional agreement with all the terms and conditions of this Public Offer without any exceptions or limitations and acknowledges that they have read its terms before accepting it.

The moment of Acceptance is when the Buyer checks the box ""Agree with the terms of the public offer"" on the Ticket purchase page and submits an Order to the Seller via the Website's information system.

Article 2. Subject of the Public Offer.

1. In accordance with the terms contained in the Public Offer, the Seller undertakes to provide the Services, and the Buyer undertakes to accept the Services and pay their cost.

2. The terms of the Public Offer also govern, but are not limited to:
– the procedure for using the Website, selecting Services by the Buyer, and purchasing a Ticket;
– the terms and conditions of payment by the Buyer for the Services;
– consent to the processing of personal data;
– any other terms and conditions determined by the Seller at their discretion.

Article 3. Procedure for Selecting Services and Purchasing a Ticket.

1. The Buyer independently selects the Services on the Seller's website and purchases the Ticket(s) for the selected Services.

2. After paying for the Ticket, the Seller sends the Buyer a scanned copy of the Ticket in pdf format to the email address provided by the Buyer during Registration. The Buyer may print a paper copy of the Ticket and present it to the Seller before the provision of the Services.

Article 4. Cost of Services and Payment Procedure.

1. The cost of Services is determined by the Seller at their discretion and is indicated on the relevant page of the Website. The cost of Services includes all taxes and fees that the Seller must pay when providing such Services.

2. The Buyer pays for the Services with their payment card on the Website using the LiqPay system by making a 100% prepayment of the Service cost. The commission for transferring funds through the LiqPay system is set by the Bank, the owner of the LiqPay payment service, and is not included in the Ticket price and is paid by the Buyer at their own expense.

Protection of information about payment instruments for paying for the Services is provided by the Bank, the owner of the LiqPay payment service.

3. The Buyer has the right to refuse to receive the Services and return the Ticket to the Seller no later than 1 (one) calendar day before the start of the Service provision period. If the Buyer refuses to receive the Services 5 (five) calendar days before the start of the Service provision period, the Buyer will be refunded the full cost of the Services (Ticket cost). If the Buyer refuses to receive the Services 3 (three) calendar days before the start of the Service provision period, the Buyer will be refunded 50% of the Service cost (Ticket cost). If the Buyer refuses to receive the Services 1 (one) calendar day before the start of the Service provision period, the Buyer will be refunded 0.5% of the Service cost (Ticket cost).

4. Payment in accordance with the conditions specified in this Public Offer, without fulfilling other conditions and/or without providing all the information specified in it, is not considered an acceptance of the offer to conclude an electronic contract (acceptance), and the payment is considered improper and is subject to return to the person who made it.

Article 5. Service Provision Period

1. The period for each type of Service is indicated on the relevant page of the Seller's Website and specified in the Ticket.

Article 6. Rights and Obligations of the Parties.

1. The Seller's obligations include:
1.1. Providing the Services properly;
1.2. Not disclosing information about the Buyers' personal data, passwords, and other access data in accordance with the Privacy Policy posted on the Website;

2. The Seller has the right to:
2.1. Unilaterally suspend the sale of Services (refuse to sell Services) in case of the Buyer's violation of the terms of the Public Offer;
2.2. Set the cost of Services at their discretion;
2.3. Unilaterally, at their discretion, make changes to the terms of the Public Offer by posting (publishing) a new version on the Website. Changes take effect from the moment they are posted (published) unless a later effective date is specified when they are published;
2.4. Post information about promotional events conducted or planned by the Seller on the Website.

3. The Buyer's obligations include:
3.1. Before accepting this Public Offer, familiarize themselves with all its terms and conditions; Familiarize themselves with all the terms and conditions of the Privacy Policy and Consent to the processing of personal data of Buyers who order Services on the website;
3.2. Familiarize themselves with the information about the Services posted on the Website before purchasing the Ticket;
3.3. Properly pay for the Services.

4. The Buyer has the right to:
4.1. Select Services on the relevant page of the Website;
4.2. Demand that the Seller fulfill the terms and obligations stipulated by this Public Offer;
4.3. Other rights provided by current legislation.

Article 7. Liability of the Parties and Dispute Resolution.

1. The Seller is not responsible for the quality of public communication channels and data transmission network disruptions, including the global Internet, which are used to access the Website.

2. Any complaint or claim from the Buyer, made in writing, will be considered by the Seller.

3. All disputes, disagreements, or claims arising from or in connection with this Agreement, including those concerning its performance, violation, termination, or invalidity, that have not been resolved through negotiation, shall be resolved in the appropriate court according to the material and procedural law of Ukraine, with respect to jurisdiction and venue.

Article 8. Force Majeure Circumstances.

1. The Parties are released from liability for untimely or improper performance of obligations under this Agreement if the non-performance results from extraordinary circumstances that are beyond the control of the Parties, such as military actions, strikes, riots, accidents, natural disasters, quarantine announcements, prohibitions, or restrictions on certain types of activities, as well as other extraordinary circumstances that arose after the conclusion of this Agreement and that directly affect the performance of its conditions and that the Parties could not foresee or prevent through reasonable actions.

2. The Party for whom it becomes impossible to fulfill obligations due to the occurrence of force majeure circumstances must immediately inform the other Party in writing about the occurrence of the aforementioned circumstances.

Article 9. Other Conditions.

1. Service descriptions do not claim to be exhaustive and may contain typographical errors.

2. The relations between the Buyer and the Seller are governed by the provisions of current Ukrainian legislation.

3. Information exchange between the Parties is carried out via electronic communication means (email) and by phone.

Article 10. Reservation on the Processing of Personal Data.

1. Personal data of Buyers are processed in accordance with the Law of Ukraine "On Personal Data Protection" and the terms of the Consent to the processing of personal data of Buyers who order Services on the Seller's website.

2. When purchasing Services, the Buyer provides their last name, first name, patronymic, contact phone number, and email address.
